İstanköy Vakıf Malları Yönetim Kurumu 15 Ocak 2019

İstanköy –Yunanistan

Bilindiği üzere derneğimiz, Rodos, İstanköy ve Onikiadalar’dan göç ederek Türkiye’ye yerleşen Türklerin kurmuş olduğu bir sivil toplum örgütüdür.

Derneğimizin amaçları arasında; Türkiye’ye göç etmiş Rodos, İstanköy ve Onikiadalı Türkler arasında dayanışmayı artırma, kültür, örf ve geleneklerini yaşatma ve öğretme ile Onikiadalar’daki Osmanlı Türklerinden kalma kültür eserlerinin yaşatılması, korunması ve restorasyonu için çalışan kurumlara yardımcı olma, kültürel mirasın korunması ve aslına sadık biçimde muhafazası da dahil her türlü kültürel haklarını korumak için girişimlerde bulunma ve adalardaki Türk mezarlarının bakımı ve korunması için çalışmalar yapma gibi konular sayılabilir.

Çalışmalarımızı gerçekleştirirken amaçlarımızdan biri de Türk ve Yunan Halkları arasında dostluk ve işbirliğinin geliştirilmesine yardımcı olmaktır. Bu bağlamda her iki ülke arasında dostluğun sağlam temeller üzerinde inşa edilmesi dileğimizdir.

Sayın Başkan

Derneğimiz, her iki ülke arasında dostluğun sağlam temellere oturtulmasının, öncelikle ilişkilerde sorun olan konuların çözümünden geçtiğini düşünmektedir.

Bunlardan birisi de “Vakıflar Sorunu”dur.

Konu İstanköy özelinde incelendiğinde, adaların yönetiminin İtalya’ya geçmesi üzerine, Evkaf’a ait malların başlangıçta bir komisyon tarafından idare edilmesi kararlaştırılmıştı. Adaların 1947 yılında Yunanistan’a geçmesi ile birlikte 517/1947 sayı ve tarihli bir yasa çıkartılmıştır.

Anılan yasada “Adalarda yürürlükte bulunan karar ve kararnameler, Yunan yasalarına aykırı olmamak koşulu ile gerekli kanunlar çıkarılıncaya kadar geçerlidir.” denmesine karşılık ilk olarak cemaat ve vakıf idaresini denetim altına almak amacı ile hükümet murahhası atanmıştır.

Buna ek olarak Yunanistan, Rodos’da olduğu üzere İstanköy’deki vakıflar yüzde 0,6 oranında emlak vergisine tabi tutmaktadır.Başka bir ifade ile İstanköy ve Rodos ‘da yaşayan Türklere ait vakıflardan, gayrımenkulleri olan ticari bir kuruluş ile aynı oranda emlak vergisi alınmaktadır.Buna karşılık Yunanistan’daki Ortodoks Hristiyan Kilise Kurumları ve Kilise her türlü vergiden muaftır. Burada bir eşitliğin olmadığı gözlemlenmektedir. Bu haksız uygulama, adeta vakıf mallarının elden çıkartılmasına bahane oluşturma mekanizmasına dönüşmüştür.

Sayın Başkan,

Bilindiği üzere Yunanistan’daki Türk vakıfları, 1923 Lozan Barış Antlaşması öncesinde Osmanlı Devleti Hukuk Sistemi’ne uygun olarak kurulmuşlardır ve bugün de Osmanlı Hukuku, İslâm Hukuku ve ikili antlaşmalara uygun olarak yönetilmeleri gerekmektedir. Bu bağlamda bilinen, ancak dile getirilmekten kaçınılan bir gerçek de, Evkaf Nizamnamesi’ne göre “Vakıf Malının alınamaz, satılamaz, mülk edinilemez ve miras olarak taksim edilemez” olmasıdır.

Anlaşmaya göre, Evkaf Nizamnamesi uyarınca şimdiye değin gerçekleştirilen satış ve bağış işlemlerinin tümü geçersizdir.

Evkaf İdaresi’nde, Cami, Okul, Medrese, Mezarlık ve Çeşme gibi inanç camiasına ve amme yararına hizmet veren taşınmazların Tapu Senetleri yoktur. Evkaf Nizamnamesi’ni düzenleyen hukukçular, vakıf malının satılmasını engellemek amacıyla anılan yapıtlar için Tapu Senedi vermemişlerdir. Bu nedenle “tapusu olmayan bir mal kanunen satılamaz” kararının geçerli olması gerekmektedir.

Öte yandan, vakıf mallarının korunmasının İstanköy ve Rodos’un Müslüman Türk ahalisinin din ve ibadet özgürlüğü ile bağlantılı bir mesele olduğu aşikardır. Bahsekonu din ve ibadet özgürlüğünün cemaat olarak kullanılabilmesi için söz konusu malların korunması elzemdir. Bu itibarla, Yunan Yönetimleri tarafından atanmakta olan Yönetim Kurullarının sürdürdüğü tasfiye işlemlerinin aynı zamanda din ve ibadet özgürlüğünü kısıtlayan bir niteliği olduğunu düşünmekteyiz.

Özetle, AİHM ve Avrupa Birliği ölçütlerine göre, şimdiye kadar yapılan bu satışların tümü usulsüz ve geçersizdir.

Sayın Başkan,

Son aylarda İstanköy’de de Vakıf Mallarının elden çıkarılması ile ilgili iki konuya dikkatinize çekmek istiyoruz. Bunlar, İstanköy’de yapılması tasarlanan Hastane Binası için vakıfa ait arazinin elden çıkarılması ile Gurniati-SCHINARI mevkiindeki 34120 metre karelik yine vakıfa ait bir arazinin 31 Ocak 2019 tarihinde müzayede ile satılacağı konusudur.

Geçmişte de Rodos Vakfına bir çok taşınmaz mal bu şekilde elden çıkarılmıştı. Günümüzde neredeyse Rodos Vakfı’na ait taşınmaz mal kalmamış durumdadır.

Sayın Başkan,

Dernek olarak, Rodos ve İstanköy’e ait aidiyetimiz ve tüzüğümüzün amaçları doğrultusunda konuyla ilgilenmek durumdayız. Ancak, atalarımızdan bize Vakıflar yoluyla kalan mirasın korunması, derneğimiz kadar, sizin de sorumluluğunuzdadır.

Vakıf mallarının satılmaması ya da devredilmemesi konularında gerekli duyarlığı göstermenizi ve alınan kararların uygulamasını durdurmanızı bekleriz.

İstanköy(Kos) Foundation Assets Board of Directors 15 January 2019

Kos – Greece

As you know our foundation is a non-governmental organisation found by Turks who moved to Turkey from Rhodes, İstanköy(Kos) and the Dodecanese.

Purposes of our foundation include supporting solidarity between Turks who moved to Turkey from Rhodes, İstanköy(Kos) and the Dodecanese, to help them sustain and teach their culture, customs and traditions, to support institutions working to maintain, protect and restore the Ottoman Turk cultural artefacts on the Dodecanese, to work towards protection of any and all cultural rights including protection of cultural heritage and maintenance of the same true to its original, and to work towards maintaining and protecting the Turkish graves on the islands.

Another purpose we pursue during our work is to contribute to development of friendship and cooperation between Turkish and Greek Peoples. In this context, it is our wish to help ensure the friendship between the countries can be built on strong foundation.

Dear Chairman

Our Foundation is of the belief that a friendship built on strong foundations between two countries relies primarily on resolution of matters which prove to be problematic in their relationships.

One of these matters is the “Matter of Foundations.”

In particular regards to İstanköy(Kos), when government of the Islands was left to Italia it was decided that a commission would manage assets belonging to Foundation. When the Islands were left to Greece in 1947 the law numbered/dated 517/1947 was enacted.

The law in question specify “The laws and regulations currently in force in the Islands will stay in force until necessary laws are enacted, provided that they are not in violation of Greek laws”, and therefore a government delegation was assigned to manage congregation and foundation assets.

In addition, as it is in Greece and Rhodes, the foundations in Kos are subject to 0.6 percent property tax. In other words, foundations of Turks living in İstanköy(Kos) and Rhodes are subject to taxation at the same rate as a commercial institution owning property. In contrast, Orthodox Christian Church Institutions and the Church in Greece are exempt from all types of tax. It can be seen that this situation displays no equality. This unfair treatment has almost turned into a mechanism to provide excuses for disposal of foundation assets.

Dear Chairman,

As you know Turkish foundations in Greece were found on basis of the Ottoman Law System before the Lausanne Peace Treaty of 1923 and thus they should be governed in accord with the Ottoman Law, Islamic Law and mutual treaties today. In this context, the truth which is known to all but avoided is that according to the Ottoman Regulations on Foundations “Foundation assets cannot be purchased, sold, possessed or inherited.”

According to the treaty, provision of the Regulations on Foundations renders all sale and donation transactions up to date null and void.

Foundations Administration does not hold any Property Deeds for properties like Mosques, Schools, Madrasas, Graveyards and Fountains which serve faithful congregations and public good. The legists who prepared the Regulations on Foundations have avoided issue of Property Deeds for such properties by design in order to prevent foundation properties from being sold. Therefore the provision that “a property without property deed cannot be sold legally” must be upheld.

On the other hand, it is clear that protection of these foundation properties is a matter connected to freedom of religion and worship for the Muslim Turk congregations of Kos and Rhodes. Protection of the properties in question is critical to allow these congregations to practice their rights of religion and worship. Therefore, it is our belief that the liquidation actions taken by the Board of Directors assigned by the Greek Government also constitute restriction of the freedom of religion and worship.

In summary, according to the ECHR and the European Union criteria, all these sales conducted up to date are unlawful and void.

Dear Chairman,

We would like to call your attention to two matters related to disposal of Foundation Assets in İstanköy(Kos) which emerged in the recent months. These are disposal of a foundation property for the Hospital Building planned to be built in Kos and again the matter of sale of a 34120 square meter foundation property at Gurniati-SCHINARI locale on 31 January 2019 to the museum.

In the past many properties belonging to the Rhodes Foundation were disposed in similar fashion. Today, the Rhodes Foundation is bereft of almost all property.

Dear Chairman,

As an Association, we are obliged to taken interest in these matters in line with our heritage in Rhodes and Kos as well as the stated purposes of our charter. However, protection of the heritage left by our ancestors to us through the Foundations falls not only on our foundation, but also on your shoulders as well.

We are expecting you to show necessary sensibility in regard of prevention of sale or transfer of foundation properties and ensure cease of the relevant decision.
